Terms and Conditions of Sale

Terms and Conditions of Sale

These are the Terms and Conditions of Sale of Tautahi Ascension Pty Ltd trading as Tautahi (ABN 38 666 902 950) (“Tautahi”, “we”, “us”) on our website located at www.tautahi.org, which is owned and operated by us (“Website”). These Terms and Conditions also incorporate our Terms of Use, Disclaimer and Privacy Policy, all of which are available on our Website.

Please read these terms carefully, as they apply to all transactions for our products, access or offerings, and may only be waived or varied by written agreement. By proceeding with a purchase on our Website, you acknowledge that you’ve read, understood and agreed to these conditions. If you have questions about your purchase, please contact us at [email protected] or +61 451 334 031.

Nature of Offerings
Tautahi offers two types of purchases through this website:

  1. Seraphic Online Store Products
Digital products available for direct purchase and download via the Website.
  2. Access to the Tautahi Field
Including digital environments, programmes and experiences that may be delivered through external platforms or account-based access.

Different terms may apply depending on the nature of your purchase, including programme-specific policies where relevant.

1. eCommerce

While we take care to ensure our Seraphic Online Store is accurate and current, errors may occur (for example, pricing or stock availability).

Submitting an order on the Website does not constitute a binding agreement. Your order is only confirmed once we process it and issue a confirmation email. If an error has occurred, we reserve the right to decline or amend the order, and will contact you to offer alternatives or issue a full refund.

2. Payment

You agree to pay the total price as listed on our Website at the time of purchase, including applicable postage or delivery charges.

We currently accept payment by credit card, debit card, PayPal, and Afterpay (where available). All payments must be received in full and cleared before delivery of any goods or services. If your payment is declined or fails, you agree to cover any bank fees or associated costs, and we may withhold delivery or cancel the order.

You confirm that you’ve read and accepted the terms of any third-party payment provider (such as PayPal or Afterpay), and understand that these services are external to our business. We are not responsible for issues arising from these third-party platforms.

Where your purchase grants access to the Tautahi Field or any of its environments, access details will be provided separately and may be subject to additional terms and policies.

Upon successful payment, you may be granted access to digital resources, environments or programmes as described at the point of purchase.

3. Discounts and Coupon Codes

Discounts and codes may be offered at our discretion. They:

  • Are valid for seven (7) days from launch unless stated otherwise
  • May not be combined with other offers
  • Apply only to full-priced items unless otherwise noted
  • Are not redeemable for cash and are non-transferable

We reserve the right to withdraw or vary any offer at any time.

We offer digital Gift Certificate Cards via our Website. These may be redeemed toward products and services we offer online, but:

  • Are valid for one (1) year from purchase
  • Cannot be redeemed for cash

9. Australian Consumer Law

Our digital products and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). If you are an Australian consumer, you are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the product or service remedied if it fails to be of acceptable quality and the failure does not amount to a major failure.

Where permitted by law, we limit our liability to one or more of the following remedies (at our election):

  • Replacement of the digital product or re-supply of the service
  • Refund of the amount paid
  • Another remedy we consider fair and reasonable

We do not offer refunds for change of mind.

12. Intellectual Property

All intellectual property rights (including trademarks, content, course materials, and digital assets) remain our property. Purchasing a product or service does not grant you ownership or right to reproduce, share or repurpose our intellectual property unless expressly stated.

13. Dispute Resolution

If a dispute arises out of these conditions, or if you are dissatisfied with a product or service, we ask that you contact us first to resolve the issue in good faith. If the dispute remains unresolved after thirty (30) days, we agree to attend mediation in Queensland, with the costs of mediation shared equally between both parties.

Neither party may initiate legal proceedings unless this process has been followed, except in cases requiring urgent interlocutory or injunctive relief.

14. Amendments and Severance

We may amend these Terms at any time by updating this page. Changes take effect immediately upon posting.

If any part of this agreement is found to be unenforceable, the remaining provisions remain in full force.

15. Termination

We may terminate this agreement at any time with notice. On termination, any amounts paid for undelivered goods or services will be refunded. Limitations of liability and disclaimers survive termination.

16. Governing Law

These terms are governed by the laws of Queensland, Australia. Any legal proceedings must be commenced in a Queensland court.
